Joint tenancy

/dʒɔɪnt ˈtɛnənsi/ noun phrase

Definition

A form of property ownership where two or more people hold equal shares with rights of survivorship, meaning when one owner dies, their share automatically passes to the surviving joint tenants. All owners have equal rights to use the entire property.

Etymology

From Old French 'joindre' (to join) and 'tenir' (to hold), through Anglo-Norman legal terminology. The concept developed in medieval English law as a way to avoid feudal inheritance restrictions and ensure seamless property transfer without probate.

Kelly Says

Joint tenancy has a built-in magic trick called 'right of survivorship' - when one owner dies, their share doesn't go through their will or to their heirs, it instantly belongs to the surviving joint tenants! This makes it popular for married couples but can create family drama when someone gets unexpectedly cut out.
